2. Acknowledgment

If You do not agree, do not use the Service.

Use of the Service is also governed by Our Privacy Policy.
3. Subscriptions
Certain features of the Service may require a paid Subscription.
3.1 Subscription Plans
Certain features of the Service are made available on a paid subscription basis ("Subscription(s)"). By purchasing a Subscription, You agree to pay the recurring fees ("Subscription Fees") as set out on the Website.
3.2 Billing & Recurring Payments
All payments for Subscriptions are processed securely by Stripe Payments UK Ltd, our authorised payment service provider. By providing a payment method, You expressly authorise Us to automatically charge the applicable Subscription Fees to Your chosen payment method at the start of each billing cycle (e.g., monthly or annually). You confirm that You are authorised to use the payment method You provide.
3.3 Subscription Period and Renewal
Subscriptions are billed in advance and renew automatically unless cancelled.
Automatic Renewal: Your Subscription will automatically renew at the end of each billing period (the "Renewal Date") unless You cancel it in accordance with this section.
3.4 Right to Cancel (Cooling-Off Period)
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, if You are a consumer (acting outside Your trade, business, or profession), You have the right to cancel this contract within 14 days of its commencement without giving any reason (the "Cooling-Off Period"). This period expires 14 days after the day the Subscription is activated.
To cancel within the Cooling-Off Period, please contact Us. We will reimburse all Subscription Fees received from You without undue delay and no later than 14 days after we are informed of Your decision to cancel.
Important – Early Access Waiver: The Service provides digital content and information that You can access immediately. If You request that We begin providing the Service during the 14-day Cooling-Off Period, You expressly acknowledge and agree that You will lose Your right to cancel this contract and receive a refund once the Service has started. By checking the box marked "I request that you begin providing my subscription immediately. I acknowledge that I will lose my right to cancel this contract under the 14-day cooling-off period once the service has started" at checkout, You confirm Your understanding and agreement to this waiver.
3.5 How to Cancel (Ongoing Subscriptions)
You may cancel the automatic renewal of Your Subscription at any time via Your Account settings or by contacting Us. If You cancel, Your Subscription will continue until the end of Your then-current billing period and will not be renewed. We do not provide pro-rata refunds for cancellations made part-way through a billing cycle, as permitted by law.
3.6 Failed Payments
If a payment attempt fails (e.g., due to an expired or insufficient card), We may retry the payment. You are responsible for ensuring Your payment information is up to date. We may suspend access to Your Subscription until the outstanding Subscription Fees are successfully charged.
3.7 Fee Changes
We may adjust Subscription Fees. We will provide reasonable notice before any change takes effect. We will notify You at least 30 days in advance of any fee change via the email address associated with Your Account. If You do not agree to the fee change, You may cancel Your Subscription before the change takes effect.
3.8 Free Trials
Free trials may be offered at Our discretion. If billing details are provided, charges apply after the trial unless cancelled.
4. User Accounts
You must provide accurate information when registering. You are responsible for safeguarding Your login details.
We may suspend or terminate accounts for violations of these Terms.
5. Property Information and Reliance Disclaimer
The Service aggregates property data, auction results, public records, and information from third parties. While We make reasonable efforts to ensure accuracy, We:
- Do not guarantee updates, accuracy, completeness, availability, valuation accuracy, or timeliness.
- Do not confirm the legitimacy of listings or auction status.
- Are not responsible for errors, omissions, delays, or incorrect information.
You agree that:
- You must independently verify any property, auction, valuation, or pricing information before making a decision, bid, or purchase.
6. No Professional or Regulated Advice
The Company is not authorised by the Financial Conduct Authority (FCA).
Nothing on the Website constitutes:
- Investment advice
- Financial advice
- Legal, valuation or tax advice
- A property recommendation or solicitation
All decisions are made solely at Your own risk.
7. Intellectual Property and Database Rights
All content, including data compilations, analytics, search tools, and listings available through the Service, is the exclusive intellectual property of the Company or its licensors.
You may not:
- Copy, scrape, export, reverse engineer, or resell data
- Bulk-download property records
- Reproduce or commercially exploit any part of the Service
- Create derivative or competing products based on the Service
unless You have written permission from the Company.
8. Prohibited Use
You agree NOT to:
- Use automated tools, bots, or scrapers
- Interfere with Service functionality
- Misuse access for commercial or competitive purposes
- Upload unlawful, harmful, defamatory, or misleading content
We may restrict, block, or remove accounts breaching this clause.
9. User-Generated Content (If Applicable)
If You submit content or data, You grant Us a perpetual worldwide licence to use, store, modify, and display it.
We may remove any content that violates laws or these Terms.
10. Links to Third-Party Websites
We are not responsible for third-party content or websites.
Use of external links is at Your own risk.
11. Termination
We may suspend or terminate Your Account without notice if You breach these Terms.
Upon termination, Your right to access the Service ends immediately.
12. Limitation of Liability
To the fullest extent permitted by law:
- Our total liability is limited to the greater of £100 or the amount You paid to access the Service.
- We are not liable for indirect, incidental, or consequential loss, including lost profit, lost opportunity, or reliance on the Service.
13. “AS IS” and “AS AVAILABLE” Disclaimer
The Service is provided without warranties of any kind, including accuracy, reliability, or uninterrupted availability.
14. Governing Law
These Terms are governed by the laws of England and Wales.
Courts of England and Wales have exclusive jurisdiction.
15. Dispute Resolution
You agree to contact Us first and attempt informal resolution before pursuing legal action.
16. Severability & Waiver
If any part of these Terms is unenforceable, the remaining provisions remain in effect.
Failure to enforce rights does not constitute a waiver.
17. Changes to Terms
We may update these Terms. For material changes, We will provide at least 30 days’ notice.
Continued use of the Service means You accept the changes.
18. Payment Processing
We use Stripe Payments UK Ltd ("Stripe") as our third-party payment service provider. Stripe is an authorised electronic money institution authorised by the UK Financial Conduct Authority (FRN: 900461). Your payment details are not stored by Us. All payment information is collected and processed by Stripe in accordance with their security standards, including the Payment Card Industry Data Security Standard (PCI DSS). The processing of your personal data in connection with payments is described in Our Privacy Policy.
